Exploring the Legal Option of Alternative Dispute Resolution as Enhancers of Business

Abstract

The relationship between taw and business performance is easily seen through the ejects of reliance on the judiciary as arbiters of business dispute. In many countries of the world, dispute resolutions via the regular courts have since ceased to be the only method of dispute resolution. This is largely on account of the unnecessary. inordinate judicial delays besides the high costs of prosecution by litigants through the court processes. Within the framework of the Nigerian legal and business systems, there is an emerging recourse to the models of alternative dispute resolutions instead of litigation. This is due to the inherent advantages of curtailing costs and saving time which, indirect^ enhance business performance. This work, therefore, attempt an analysis of the legal regime of alternative dispute resolution as catalysis for improvement of business performance in Nigeria. The descriptive and critical methods of analysis were adopted. The study concluded with recommendations, int. lit ding the imperatives for a paradigm shift from litigation of alternative dispute resolution, especially within the framework of Nigerian business and corporate climate because of its win-win advantage Legal Option, Alternative Dispute Resolution and Business Profitability
