Abstract
The agitation for the protection of audiovisual performances arose from the transfer of performers’ rights to producers in order to produce and broadcast their works. With this came the challenge of finding ways for producer or performers’ to receive royalties for exploitation of audiovisual works abroad. The absence of an international treaty giving performers’ control over how and when their work is used abroad, or any legal right to payment creates a lacuna that was filled by the Beijing Treaty on Audiovisual Performances, 2012. This paper examines the concept of ‘performance’ and ‘audiovisual performance’; it further examines the basic provisions of the Beijing Treaty on Audiovisual Performance, its prospects and challenges which later culminates in a justification of its adoption and a recommendation for Nigeria to accede to it.
