Abstract

The agitation for the protection of audiovisual performances arose from the transfer of performersâ€™ rights to producers in order to produce and broadcast their works. With this came the challenge of finding ways for producer or performersâ€™ to receive royalties for exploitation of audiovisual works abroad. The absence of an international treaty giving performersâ€™ control over how and when their work is used abroad, or any legal right to payment creates a lacuna that was filled by the Beijing Treaty on Audiovisual Performances, 2012. This paper examines the concept of â€˜performanceâ€™ and â€˜audiovisual performanceâ€™; it further examines the basic provisions of the Beijing Treaty on Audiovisual Performance, its prospects and challenges which later culminates in a justification of its adoption and a recommendation for Nigeria to accede to it.
