ABSTRACT
The paper delves into the principle of rule of laws as an essential ingredient of democratic systems. It would be recalled that most of the developing countries in the world, particularly in African continent had been subjected to long rule of military regime. As a result of that, the fundamental rights of the citizenry had been trampled upon. People were severally detained without trial and clique within these administrations viewed themselves as more superior than the bloody civilians. The trust of this paper is that it provides an insight into how the oppressed in these parts of world could exercise their fundamental human rights and the government should operate within the purview of the law. The study adopted primary and secondary sources of generating data with particular emphases on the use of literatures, journals, magazines, electronic publications to analyse findings. It was observed that citizens were detained and subjected to various acts of dehumanization without the application of “habeas corpusâ€.
