Abstract
Freedom of information (FOI) is considered as an integral aspect of freedom of expression. Lack of FOI laws, will prohibit citizens from effectively accessing information about basic services, fully participate in the social and economic development of their countries or hold their governments accountable for public spending, which can in turn adversely affect their rights to health, employment and education, and to fight corruption. In Nigeria, infringement on the citizen’s right to information and government transparency occur whenever the provisions of the FOI Act are defied by public institutions and their officers. The aim of this work is to critically investigatethe extent of enforcement measures Nigerians have under the FOI Act, in case there is a refusal by public institutions/officers to grant right of access to information. This aim is achieved by analyzing some decided cases and whether the Courts have complied with summary judgments as stipulated by the FOI Act. This research strongly recommends that the fees to be paid when requesting for information from a public body as provided for in the FOI Act should be expunged so as to grant free access to information in Nigeria. It is concluded that public transparency is key to a democratic and healthy society, there is no other time than now that Nigeria needs effective implementation of the FOI laws so as to consolidate her growing democracy.
