Abstract
Upon the death of a person, whether such person leaves a will or not, probate is required for the administration of the estate of the deceased. Generally, persons upon whom such an estate is vested are referred to as personal representatives. These personal representatives include executors appointed by the testator in his will or by Representation or Administrators. The term ‘personal representative’ is generic in nature describing those persons who will take charge of a deceased’s estate. Ordinarily nobody is allowed to deal or entitled in law to deal in any way with the property of a deceased fellow unless he has been previously permitted or authorized to act in that capacity by obtaining a grant of probate or letter of administration from one of the High Court Probate registries. But where there is a will which has been validly made by the testator before his death, this will be abided by in order to carry out the wishes of the testator. The main problem is to determine who is an executor, his functions and particularly the limitations of his powers during the pendency of administering the estate of a deceased person. While the major objectives of this paper are to examine the formula considered in appointing an executor or executors; to also examine the extent to which he can exercise his powers over the estate of a deceased fellow during the pendency of administration of an estate.
