Abstract
This paper considers the doctrine of election in equity. It focuses on the options available to the beneficiary and how he can claim and disclaim the assets of the demised settler there/a It a/so discusses the sustainability of the concept of a disclaimer. However, the apparent effect of a valid will ascertained with the principles of construction and, simultaneously, the effect of the wi/I may be modified during the pendency of the administration of an estate, if the beneficiary disclaims his benefits, or if, under the equitable doctrine, he is put to elect between the alternatives. Otherwise, the other party or deprived beneficiary must be adequately compensated. Where these election options have been settled, the personal representatives of the testator will know how they should distribute the property and all legacies as stipulated in the testamentary document.
