What is now known as Nigerian Trademarks law is tied to our colonial history and British policy to protect products and manufacture of its home industry to probably control the local market as the first Trademarks Ordinance of 1901 allowed marks from any part of the world to be registered in Nigeria only giving preferences to marks registered in Britain.
This paper attempted to find the usefulness of trademark law in Nigeria and whether, it has truly functioned to protect consumers and the goodwill of businesses and encourage technology transfer; that is, if at all: it has done so.
Rapt attention was paid to the issues of violation of trade marks law, prosecution and challenges faced in the enforcement of Trademarks Act. And this was achieved by checking out on the Trademarks Act, Cap. 13, L.F.N 2004 and recently decided cases.
It is also hoped that, gaps in the law due to long age, rapid attempt at industrialization and technology advancement will be spotted and valuable suggestions made on the way forward to benefit trade mark administrators and practitioners in Nigeria.
