Abstract
Technological developments and the advent of the internet have led to a paradigm shift in all spheres of human activities, including contractual transactions. Contractual transactions now leverage on internet technology to initiate electronic contracts, popularly called e-contracts. The application of electronic platform for commerce has undoubtedly brought about several innovations and dynamism to contractual agreements globally, but this is not without its own peculiar challenges. This study is devoted therefore to identifying these challenges and exploring possible solutions. The study deployed the analytical and qualitative research methods to unravel what constitute electronic contract, its various types, its formalities and its unique characteristics. Furthermore, the study carried out an expose on the issue of electronic signature, a distinctive feature of e-contract. A comparative analysis of traditional contract and e-contract was also evaluated in the course of the study to juxtapose their similarities and differences. In conclusion, the study proposed recommendations to improve the effective deployment of e-contract in Nigeria.
