Abstract
Feminist legal theory generates a critique of notions of female inequality and sexual domination by man in legal scholarship and legal theory, that force subjugates women in society. It analyses, evaluates and criticises laws from a feminist and rights-based perspective, as well as advocating for women’s rights. Furthermore, legal feminist theory seeks to investigate, explore, assess and criticise the law from a feminist perspective. This theory presumes that the law has been the cause-effect in the subjugation and oppression of women; it therefore seeks to develop the law as an instrument for the liberation of women.
